How to Use This Report
This report is built to be read in the order the actual export process happens, not as a list of disconnected requirements. Section 2 shows you the sequence end to end. Section 3 tells you, for each requirement, whether it's something you arrange as the exporter or something your Kenyan importer arranges. Sections 4 onward go into the technical detail: standards, testing, labelling, costs, and the mistakes that most commonly cause delays or rejections.
Two roles, one shipment
- Exporter: Country of origin-side certification, testing, PVoC/CoC, shipping documents.
- Importer (your Kenya-based buyer or their agent): Permits, port-side inspection, customs clearance, market authorization.
- Where a step is genuinely shared, it's marked accordingly. If you don't yet have a confirmed importer of record in Kenya, treat that as your first open item. Please note, several steps in Section 3 cannot start without one.
Compliance Sequence - Start to Finish
The sequence comprises of seven phases, in order. This category doesn't carry the additional import permit or licensing layer seen in dairy or alcohol categories, so the sequence is comparatively straightforward.
| # | Phase | What happens | Responsibility | Timing | Output |
|---|---|---|---|---|---|
| 0 | Classification & readiness check | Confirm HS code, applicable standard, and declared chocolate type (Section 7 governs which composition minimums apply) | Exporter | Before finalizing production run | Confirmed HS code + standard |
| 1 | Origin-side certification | Accredited lab testing against the composition, microbiological, heavy metal, and mycotoxin tables (Section 7) | Exporter | 4 to 8 weeks before shipment | Certificate of Analysis |
| 2 | Pre-shipment conformity assessment | PVoC inspection/testing via KEBS-appointed agent | Shared | Before or at point of loading | Certificate of Conformity (CoC) |
| 3 | Shipping documentation | Commercial invoice, packing list, Certificate of Origin, IDF, bill of lading | Shared | At time of shipment | Complete document set |
| 4 | Arrival & inspection | Port Health review, KEBS verification against CoC | Importer | On arrival | Inspection clearance |
| 5 | Customs clearance | Duty assessment, VAT, IDF, Railway Levy, KRA release | Importer | On arrival | Customs release |
| 6 | Market authorization | Import Standardization Mark affixed before retail sale | Importer | After clearance, before sale | Market-ready product |
Responsibility Matrix
Just as like in Section 2 above, the following is applied to every individual requirement. Use this to divide the work with your importer before shipment, to avoid last minute delays.
| Requirement | Who's responsible | Notes |
|---|---|---|
| Product testing / Certificate of Analysis | Exporter | Accredited lab; test against the composition, microbiological, heavy metal, and mycotoxin tables in Section 7 |
| PVoC / Certificate of Conformity | Shared | Exporter engages the agent; agent conducts inspection/testing at origin. We can help to coordinate this step. |
| Certificate of Origin | Exporter | Issued by the chamber of commerce in the country of origin. This is a mandatory document |
| Commercial invoice, packing list, IDF | Shared | IDF is typically filed by the importer or clearing agent using exporter's invoice |
| Port Health inspection | Importer | Happens after arrival; importer or clearing agent must be present |
| Customs duty, VAT, levies, KRA clearance | Importer | You should still model these costs because they affect your landed-price negotiation |
| Import Standardization Mark | Importer | Affixed after clearance, before the product reaches retail shelves |
